I. CONCLUSION OF CONTRACT / RESALE

  1. The organiser of the event offered is Bilder der Zukunft e.V., Rüdesheimer Straße 21, 65197 Wiesbaden (hereinafter referred to as the ‘Organiser’).
  2. By purchasing an admission ticket, a contractual relationship with regard to attending the event is established exclusively between the ticket holder (customer) and the respective Organiser. The following General Terms and Conditions apply exclusively to these contractual relationships; any possible regulations of the customer do not apply.
  3. The offer to conclude a contract is made by the customer as soon as they have clicked on the ‘Buy now’ button. A contract between the customer and the organiser is only concluded when the organiser sends a confirmation email to the customer.
  4. Commercial resale of the admission ticket(s) is not permitted; non-commercial resale is only permitted at a price equal to the printed price of the admission ticket(s) plus proven fees/costs incurred during the original purchase (e.g. postage and shipping costs), up to a maximum of 25% of the printed price. In the event of a breach of the aforementioned condition, the organiser has the right to refuse admission to the event without compensation. Resale in the access and / or entrance area of the event venue covered by the Organiser's domiciliary rights is not permitted. The falsification and production of the organiser's admission tickets will be prosecuted under civil and criminal law.
  5. Severely disabled persons do not receive a discount.


II. PRICE COMPONENTS / PAYMENT OPTIONS / SHIPPING COSTS

  1. There are no shipping costs.
  2. The payment options are detailed in the order form. Tickets can be paid for in advance, by credit card (Visa, Mastercard, American Express or UnionPay) or via PayPal. The statutory VAT is included in the price, but is shown separately during the ordering process. The total price of the order including all fees is due for payment immediately after conclusion of the contract for both payment methods.
    To use PayPal, you need a PayPal account in which your bank or credit card details are stored. You pay by entering your e-mail address and a password. You will then receive a payment confirmation by e-mail. The order will be processed immediately. The General Terms and Conditions of the financial services provider PayPal (PayPal (Europe) S.à.r.l. et Cie, S.C.A., ,22-24 Boulevard Royal, L-2449 Luxembourg) also apply to the payment transaction.


III. NO RIGHT OF CANCELLATION

According to Section 312g (2) sentence 1 no. 9 BGB, there is no right of cancellation for consumers or the right of cancellation for consumers may expire prematurely in the case of contracts for the provision of services in the areas of accommodation for purposes other than residential purposes, transport of goods, vehicle rental, delivery of food and beverages and the provision of other services in connection with leisure activities if the contract provides for a specific date or period for the provision.
Therefore, there is no right of cancellation for services provided by the organiser in the area of leisure activities, such as the offer of tickets for events. Every order for tickets is therefore binding immediately after confirmation by the organiser in accordance with Clause I, 3.


IV. CHANGES / CANCELLATIONS

  1. In the event of postponements of the event that are not the fault of the organiser, the organiser is entitled to declare the validity of the original tickets for the postponed event for the new, postponed date of the event. In such cases, it is not possible to return the tickets to the organiser or to cancel the ticket purchase as a result of the postponement, unless it can be proven that the ticket holder cannot reasonably be expected to attend the rescheduled date.
  2. Tickets cannot be exchanged or refunded. If the event is cancelled, the ticket price can be refunded up to a maximum of 7 days after the scheduled date of the event.
  3. The organiser reserves the right to change the programme up to the day of the event


V. HOUSE RIGHTS / EVENT RULES / PHOTOGRAPHS

  1. The visitor agrees that the organiser may create, reproduce and publish in print and audiovisual media images of the visitor as a participant in the event for information and documentation purposes. This consent is granted free of charge and is unrestricted in terms of time and space. The legal basis is Art. 6 para. 1 lit. a) and f) GDPR. In accordance with Art. 21 GDPR, you may have the right not to be photographed - please contact the organiser or photographer immediately if you wish to assert this right.   2. The organiser is entitled to exclude and expel visitors from the event without compensation if they enter the stage area, cause or participate in violent confrontations, engage in sexist or racist acts or express such attitudes.
  3. To ensure the safety of guests, the organiser reserves the right to carry out searches for dangerous and hazardous items and to exclude such items from being brought to events.
  4. It is prohibited to bring dangerous objects such as glass containers, pyrotechnic articles and weapons.
  5. Unless otherwise stated, smoking is prohibited on the premises of the event.


VI LIABILITY

  1. The organiser shall in any case be liable without limitation under the Product Liability Act, for damage caused intentionally or by gross negligence, in the event of fraudulent concealment of defects, and for damage resulting from injury to life, limb or health. Liability for damages arising from the breach of a guarantee is also unlimited. In the event of a breach of essential contractual obligations (so-called cardinal obligations) which is only due to simple negligence, the organiser's liability shall be limited to compensation for foreseeable damage typical of the contract.
  2. Except in the cases mentioned in paragraph 1, the organiser is not liable for damages caused by simple negligence. The organiser accepts no liability for personal property. No liability is accepted for lost tickets.
  3. Insofar as the organiser's liability is excluded or limited in accordance with the above paragraphs, this also applies to the liability of its vicarious agents and assistants.
  4. All details and information published on the organiser's website, printed programme, newsletter or other communication channels have been carefully researched and checked by the organiser. Neither the organiser nor the suppliers of this information can accept any liability for the accuracy, completeness and up-to-dateness of the information.
  5. The respective providers are responsible for third-party websites to which the Organiser refers via hyperlinks.


VII. FINAL PROVISIONS

  1. The customer shall only have a right of set-off if his counterclaims have been legally established or are undisputed or recognised by the organiser. Furthermore, the customer only has a right of retention if and insofar as his counterclaim is based on the same contractual relationship.
  2. The law of the Federal Republic of Germany shall apply exclusively. Irrespective of the above provision on the choice of law, consumers whose habitual residence is outside the Federal Republic of Germany may always invoke the law of the country in which they are domiciled.
  3. The sole place of fulfilment for delivery, performance and payment is Wiesbaden, provided that the customer is an entrepreneur within the meaning of § 14 BGB.
  4. If the customer is a merchant, the exclusive (also international) place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship shall be Wiesbaden. This also applies to non-merchants in the case of cross-border contracts.
  5. From 15 February 2016, the European Commission will provide a platform for online dispute resolution here. The organiser's email address is info@see-conference.org. The organiser is not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
